Service Description

The Rybená solution represents the pinnacle of web accessibility in the current market, offering a comprehensive and innovative approach. Composed of a multifaceted software, Rybená provides three distinct tools aimed at reaching a broader audience, including people with disabilities and those without. These tools include resources for simultaneous LIBRAS translation and text-to-speech conversion in various formats, such as images, links, and PDF documents, among others.

The innovative features of Rybená have a significant impact on the lives of more than 60 million people in Brazil. In addition to promoting social inclusion, the solution enables these people to enjoy a more autonomous and enriching online experience.

Rybená is in full compliance with accessibility legislation, being the solution most aligned with current legal requirements. It offers "Deaf people, visually impaired, people with intellectual and cognitive disabilities, people with dyslexia, color blindness and its variations, users with ADHD, as well as Functional Illiterates, Elderly, and other people with reading and text comprehension difficulties" the possibility to understand web page texts in an untutored way. Using cutting-edge technology, 100% national, Rybená is capable of translating texts from Portuguese to Brazilian Sign Language (LIBRAS) and converting texts to speech, with a natural and fluent narration in three languages: Portuguese, English, and Spanish.

Concepts and Definitions

  • LGPD: Brazilian General Data Protection Law, Law No. 13,709/2018, regulates personal data processing activities in Brazil
  • Disclosing Party: Client, contractor
  • Receiving Party: Rybená Assistive Technologies Ltda.
  • Personal Data: Information related to an identified or identifiable natural person
  • Sensitive Data: Personal data related to religion, ethnicity, opinions, and other information that may cause embarrassment, exposure, or discrimination of the data subject
  • Data Subject: Natural person to whom personal data subject to processing refers
  • Processing: Operations performed with personal data, such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation, or control of information, modification, communication, transfer, dissemination, or extraction
  • Encryption: Conversion of data from a readable format to an encoded format, which can only be read after decryption
  • NMT (Neural Machine Translation): Technique that uses neural networks for automatic translation

Obligations of the Parties

Rybená's Obligations (Receiving Party)

  • Provide the Rybená solution in accordance with agreed technical specifications
  • Guarantee service availability according to established service levels
  • Maintain the security and integrity of systems and processed data
  • Offer technical support under contracted terms
  • Comply with all legal and regulatory obligations applicable
  • Keep documentation updated and accessible to the client

Client's Obligations (Disclosing Party)

  • Correctly implement the Rybená script in accordance with technical documentation
  • Ensure that no sensitive data is improperly exposed in translation
  • Keep the Rybená script updated according to technical recommendations
  • Provide truthful information for technical support when requested
  • Comply with accessibility obligations applicable to their segment
  • Not perform reverse engineering or attempt to copy the solution

Common Obligations

  • Maintain confidentiality of shared information
  • Collaborate in technical incident resolution
  • Immediately communicate any security breaches
  • Respect intellectual property rights
  • Act in good faith in all interactions

Confidentiality and Secrecy

Confidential Information

Each party may have access to the other's confidential information for the execution of service provision. Any programming elements of the Service; data and/or information of the parties exchanged in virtue of the Service; and any constitution or business information of the parties provided in the execution of this contract's object are considered confidential information.

Exceptions

Information will not be considered Confidential Information when:

  • It is or becomes publicly known without such knowledge having come from the other party
  • It was already possessed by the other party before provision under the contract terms
  • It is independently developed by the other party, provided this is proven
  • Its disclosure is required by law, court order, or competent administrative authority

Commitments

  • Safely store received Confidential Information and not disclose it to third parties
  • Not use Confidential Information for purposes other than executing the contracted object
  • Implement necessary procedures to prevent undue disclosure of confidential information by employees and/or representatives

No party will be responsible for any compromise or disclosure of confidential information caused by third parties unrelated to this contract.

Classification Levels

  • Public: Free use and content can be publicly disclosed
  • Internal: Transits internally within Rybená
  • Secret: Accessible only by a restricted group of people

Data Classification Guidelines

  • Protect information according to its importance and consequences if compromised
  • Meet regulatory and legal requirements
  • Comply with contractual obligations
  • Classification independent of format, location, and storage media

Information Lifecycle

  1. Connection creation and translation request
  2. Request acceptance and authentication
  3. Translation in NMT (Neural Machine Translation)
  4. Vectorization frame sending as response
  5. Automatic disposal if the doNotTrack tag is enabled
  6. Data persistence in log if the tag is not enabled
  7. Knowledge generation for NMT from registered data

Data Retention

  • Secret Information: During the contractual relationship or for the time necessary to fulfill the processing purpose or legal requirements
  • Internal Information: Same conditions as Secret Information
  • Public Information: Same conditions as Secret Information

The classification may change during the lifecycle, respecting the reclassification lifecycle. The processing of personal information must be done transparently and with respect to the contracting party, with restricted access regardless of confidentiality classification.

Local Storage and Similar Technologies

Statement about Local Storage

Rybená does not use cookies for personal data collection. We exclusively use the browser's local storage (localStorage) for essential technical functionalities.

localStorage Usage

We use localStorage only for:

  • Maintain tool state: Save accessibility preferences and customized settings
  • Identify first use: Display initial tutorial only for new users
  • Preserve settings: Maintain the operation mode selected by the user between sessions

Storage Characteristics

  • Local and exclusive: Data remains stored only on the user's device
  • No personal identification: We do not store information that can identify the user
  • No sending to servers: Data remains in the browser and is not transmitted
  • Technical functionality: Only to improve the tool's user experience

User Control

The user has full control over localStorage:

  • Manual cleaning: Can clear browser data at any time
  • Anonymous browsing: Anonymous browser use prevents storage
  • No privacy impact: Stored data does not contain personal information

Third-party Technologies

We do not use third-party technologies for:

  • Behavior tracking
  • Profile analysis
  • Targeted advertising
  • Personal data collection
  • Analytics or individual statistics

Disclaimer of Responsibility

Important

Liability Limitations

Rybená informs that it is not responsible for the improper use of the Plugin. The plugin will read, translate, and process all sent information for translation, potentially including data that the user considers sensitive.

Contractor's Responsibilities

Data processing and preservation are maintained with the highest security standards, however, it is not possible to distinguish at the time of translation whether specific content is personal or sensitive data.

Rybená is not responsible for sensitive content received in an undetectable way in translation or incorporated into a URL. The contractor must ensure that no sensitive data is attached to the page URL or translation content.

Control Configurations

If the contractor has concerns about sensitive data, they should choose to disable the spelling data collection module as illustrated in the technical documentation available at Spelling Data.

Data Protection

Spelling data is collected completely anonymously, without any information that can identify the user, the source site, or personal data. However, individual words may be considered sensitive depending on the context, and the contractor should evaluate the need to disable this functionality through the doNotTrack parameter.

Force Majeure

Rybená will not be responsible for service failures resulting from cases of force majeure, including but not limited to: natural disasters, wars, riots, strikes, internet provider failures, large-scale cyber attacks, or other circumstances beyond its reasonable control.

Service Availability

Rybená strives to maintain high service availability, but does not guarantee uninterrupted operation. Scheduled and emergency maintenance may cause temporary unavailability.

Intellectual Property

Rights over the Solution

The Rybená solution, including all source code, algorithms, interfaces, documentation, and visual elements, is the exclusive intellectual property of Rybená Assistive Technologies Ltda., protected by applicable copyright and industrial property laws.

Licensing

The client receives a non-exclusive, non-transferable, and limited license to use the Rybená solution on their websites and applications during the contractual period, under the terms and conditions established.

Restrictions

It is expressly prohibited:

  • Perform reverse engineering, decompilation, or attempt to extract the source code
  • Modify, adapt, or create derivative works of the Solution
  • Sell, rent, license, or sublicense the Solution to third parties
  • Remove or alter copyright notices or registered trademarks
  • Use the Solution for direct or indirect competition with Rybená

Trademark and Commercial Name

The names "Rybená", logos, and other registered trademarks are the exclusive property of Rybená Assistive Technologies Ltda. The client may not use these trademarks without express written authorization.

Duration and Use Conditions

Usage Period

The service will be provided for the period established in the commercial proposal, and may be automatically renewed for successive periods, unless either party manifests otherwise with a minimum of 30 days' notice.

Service Interruption

Non-payment of the contracted consideration within the stipulated period may result in service suspension and, persisting in default for more than 30 days, in the interruption of provision.

Termination Conditions

Any party may terminate the service use in the following cases:

  • Serious violation of any established guideline
  • Improper use of the Rybená Solution in disagreement with these terms
  • Repeated failure to comply with contractual obligations
  • Insolvency or bankruptcy of either party

Termination Effects

Upon termination of provision, the client must:

  • Immediately cease the use of the Rybená Solution
  • Remove the script and all related elements from their systems
  • Return or destroy all received confidential documentation
  • Pay amounts due up to the termination date

Survival of Obligations

The confidentiality, personal data protection, and intellectual property obligations will survive the termination of provision for the period necessary for their effective protection.

  • Basic Support: Email service during business hours
  • Premium Support: Priority service with reduced response time
  • Enterprise Support: 24/7 service with dedicated account manager

Response Times

  • Critical: Service within 2 hours

  • Low: Service within 48 hours
